This Unified Service Agreement (“Agreement”) is a comprehensive document that includes Sentidant’s Terms of Service, Privacy Policy, AI Policy, and Cookies Policy. By using Sentidant’s products and services, including our website, mobile application, wearable device and cloud data services (collectively, the “Services”), you agree to the terms and policies outlined below.

If you do not agree with any part of this Agreement, please discontinue use of the Services.

Terms of Service

Use of the Services

You may use our Services only for lawful purposes and in accordance with this Agreement. You agree not to:

Use the Services in any way that violates any applicable law or regulation.
Attempt to gain unauthorized access to any part of the Services, our servers, or other systems.
Engage in any activity that could harm, disrupt, or interfere with the functioning or security of the Services.

Violation of the above may result in suspension or termination of your access. You are responsible for ensuring that your use is compliant with applicable laws.

Intellectual Property

All content and materials available through the Services, including text, graphics, logos, images, software and device firmware, are the property of Sentidant or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use our mobile app and other software solely under this Agreement.

You may not copy, reproduce, distribute, display, modify, or create derivative works without prior written consent.

Accounts and Security

You may need an account to access certain features. You agree to provide accurate and current information, keep your credentials confidential, and notify us immediately of unauthorized use.

User Submissions

By submitting feedback, content, or materials, you grant Sentidant a non-exclusive, royalty-free licence to use and display them to operate and improve the Services. You represent that you hold rights to submitted content and that it does not infringe or contain malicious/unlawful material.

Disclaimer of Warranties

The Services are provided on an “as is” basis. Sentidant makes no warranty that they will meet your requirements, be uninterrupted, error-free, or accurate.

Emotional well-being insights provided by AI are informational only and not medical advice.

Limitations of Liability

To the fullest extent permitted by law, Sentidant and affiliates are not liable for indirect, incidental, or consequential damages, loss of profits, data, goodwill, or other intangible losses.

Aggregate liability will not exceed the amount you paid us in the 12 months preceding a claim.

Third-Party Services and Links

The Services may link to third-party websites or integrate with providers (e.g., Google Firebase). These are not controlled by Sentidant and are subject to third-party policies.

Changes to this Agreement

We may update this Agreement at any time. Material changes will be communicated, and continued use after changes signifies acceptance.

Governing Law and Dispute Resolution

This Agreement is governed by Swiss law (with protections of local laws where applicable). Disputes fall under the jurisdiction of the courts of our principal place of business unless law requires otherwise.

Privacy Policy

Sentidant AG (“Sentidant”, “we”, “our”, “us”) is committed to protecting your privacy in compliance with GDPR, Swiss nFADP, and other applicable data privacy laws. By using the Services, you acknowledge that your personal data (including sensitive biometric data) will be processed as described here.

Biometric/emotional data is treated with strict confidentiality, never shared with advertisers or insurers.

Data Storage, Security and Retention

Data may be stored in Switzerland, the EU, or the U.S. with safeguards.
Data is encrypted in transit and at rest. Security measures also include access controls, monitoring, and breach response.
Biometric data is deleted within 3 years of last use (or earlier upon request).

Limitations of AI-Generated Feedback

Use reflectively; AI is a tool for awareness, not direction.
